California Overtime Laws

Overtime laws are crucial employment rights that ensure workers receive fair compensation for their additional work hours. If you’re in California, understanding these is imperative. 

According to the overtime laws in California, certain categories of employees are eligible to earn extra wages if they work a certain number of hours. Specifically, non-exempt workers who are either 18 years or older or aged 16 or 17 and qualify for legal exemptions from school requirements are eligible for overtime.

Overtime Pay – 1.5x Regular Rate of Pay

Certain circumstances warrant the payment of 1.5x normal wage rate to non-exempt employees in California, including: 

  • Working more than 8 hours up to 12 hours within a single workday; or
  • Exceeding 40 working hours in any given workweek, or
  • Working 7 consecutive days in one week – provided no more than 8 hours were worked on the 7th day.

In California, the general overtime provisions are that a nonexempt employee 18 years of age or older, or any minor employee 16 or 17 years of age who is not required by law to attend school and is not otherwise prohibited by law from engaging in the subject work, shall not be employed more than eight hours in any workday or more than 40 hours in any workweek unless he or she receives one and one-half times his or her regular rate of pay for all hours worked over eight hours in any workday and over 40 hours in the workweek…”

Overtime Pay – 2x Regular Rate of Pay

In other situations, workers are entitled to 2x their regular rate of pay instead. These situations include

  • Working more than 12 hours in one workday; or 
  • Working more than 8 hours on the 7th consecutive workday in one week.
