How a Unpaid Overtime Lawyer in San Diego Can Help With Your Unpaid Overtime Claim

Soliciting the help of a lawyer for an unpaid overtime claim significantly facilitates this complicated process. Here are several ways employing a skilled attorney can help with your claim:

Understanding of Wage and Hour Laws

Experienced lawyers provide clarity on how federal, state, and local wage and hour regulations that govern overtime pay apply to your specific circumstances.

Calculating Unpaid Overtime Damages

An experienced lawyer knows how to calculate unpaid overtime, including factors such as bonuses or on-call time. You can’t ensure a fair settlement or verdict unless you know exactly what is owed to you.

Negotiating and Litigating Your Claim

A lawyer is equipped to negotiate a settlement on your behalf or to fight for you in court if litigation becomes necessary. This process can involve collecting evidence and presenting a strong case to an arbitrator or judge and jury.

Hiring a lawyer who specializes in unpaid overtime claims offers you expert guidance during this difficult time. Don’t hesitate to contact us today to schedule a free consultation with an unpaid overtime lawyer.

California Overtime Laws

Overtime laws are crucial employment rights that ensure workers receive fair compensation for their additional work hours. If you’re in California, understanding these is imperative.

According to the overtime laws in California, certain categories of employees are eligible to earn extra wages if they work a certain number of hours. Specifically, non-exempt workers who are either 18 years or older or aged 16 or 17 and qualify for legal exemptions from school requirements are eligible for overtime.

Overtime Pay – 1.5x Regular Rate of Pay

Certain circumstances warrant the payment of 1.5x normal wage rate to non-exempt employees in California, including:

  • Working more than 8 hours up to 12 hours within a single workday; or
  • Exceeding 40 working hours in any given workweek, or
  • Working 7 consecutive days in one week – provided no more than 8 hours were worked on the 7th day.

In California, the general overtime provisions are that a nonexempt employee 18 years of age or older, or any minor employee 16 or 17 years of age who is not required by law to attend school and is not otherwise prohibited by law from engaging in the subject work, shall not be employed more than eight hours in any workday or more than 40 hours in any workweek unless he or she receives one and one-half times his or her regular rate of pay for all hours worked over eight hours in any workday and over 40 hours in the workweek…”

Overtime Pay – 2x Regular Rate of Pay

In other situations, workers are entitled to 2x their regular rate of pay instead. These situations include

  • Working more than 12 hours in one workday; or
  • Working more than 8 hours on the 7th consecutive workday in one week.

Understanding your rights under California’s labor laws regarding overtime laws is essential, as it empowers you to ensure employers fully meet their obligations.

What To Do If Your Employer Refuses to Pay You Overtime

If your employer refuses to pay overtime, you may need to explore taking further action. Often, employees in such circumstances opt for filing a wage claim with California’s Labor Commissioner. The response to this claim can take three courses:

Claim Dismissal

The deputy labor commissioner reviewing your case might decide there is no basis for your claim, and they will dismiss it.

Refer The Matter – Conference

If there is evidence of an overtime violation, the commissioner can decide to refer the matter to a conference. In this situation, you and your employer try to resolve the issue without going to a hearing. This is a fairly quick and amicable way to resolve the dispute.

Refer The Matter – Hearing

If the issue cannot be resolved through a conference, the commissioner can refer it for a hearing. In this proceeding, the parties and witnesses testify under oath and argue for or against a wage violation.

File a Lawsuit

Alternatively, if the administrative process does not yield favorable results or is not suitable for your situation, an employee has another option available: file a lawsuit against their employer seeking compensation for unpaid overtime.

No matter how you choose to pursue your claim, enlisting professional legal support should be among your first steps.
